TIPSY Beverages, Inc. ("TIPSY," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit gettipsy.com (the "Site"), purchase our products, or otherwise interact with our services (collectively, the "Services").
Our products and Services are intended for adults 18 years of age and older and are sold and shipped only within the United States.
By using the Site or Services, you acknowledge that you have read and understood this Privacy Policy.
1. Scope
This Privacy Policy applies to personal information we collect through:
- Our website at gettipsy.com
- Purchases of our products, including subscription orders
- Email and SMS communications you have opted into
- Customer service interactions
- Reviews, surveys, and user-generated content you submit
- Advertising we run on third-party platforms
It does not apply to third-party websites you may reach through links on our Site. Those sites have their own privacy policies, which we encourage you to review.
2. Categories of Personal Information We Collect
In the past twelve months, we have collected the following categories of personal information, as defined under the California Privacy Rights Act ("CPRA") and similar U.S. state privacy laws.
Identifiers. Your name, email address, mailing address, telephone number, account credentials, IP address, device identifiers, cookie identifiers, advertising identifiers (such as Meta's fbp and fbclid), and other online identifiers.
Customer Records. Shipping and billing addresses, telephone number, and limited payment information. We do not store full payment card numbers; these are handled by our payment processors (Shopify Payments, Shop Pay, Apple Pay, PayPal, and others available at checkout).
Commercial Information. Records of products purchased, subscription status, products viewed, cart activity, return and refund history, and similar transaction records.
Internet or Network Activity. Information about your interaction with our Site, including pages viewed, links clicked, browsing history within our Site, referring URLs, search terms used, advertisements interacted with, and timestamps of activity.
Geolocation Data. Approximate location derived from your IP address. We do not collect precise geolocation (such as GPS-level location).
Audio, Visual, and Similar Information. Photos, videos, and other user-generated content you submit to us or post on social media tagging TIPSY, when you have provided consent for marketing use.
Inferences. Inferences drawn from the categories above to create a profile reflecting preferences, characteristics, predispositions, behavior, attitudes, and likely interests.
We do not collect Sensitive Personal Information as defined under the CPRA. This category includes government-issued identifiers, precise geolocation, racial or ethnic origin, religious beliefs, union membership, contents of mail, email, or text messages (other than those directed to us), genetic data, biometric information, health information, and information about sexual orientation or sex life. Because we do not collect this category of information, the right under California law to limit its use does not apply to our practices.
3. Sources of Personal Information
We collect personal information from the following sources:
Directly from you when you create an account, make a purchase, sign up for our email or SMS lists, contact customer service, submit a review, respond to a survey, or share user-generated content with us.
Automatically from your device through cookies, pixels, web beacons, server logs, and similar technologies as you interact with our Site.
From our service providers who help us operate the Site and fulfill orders, including Shopify, Klaviyo, Loop Subscriptions, payment processors, and shipping carriers.
From advertising partners including Meta and Google, who may share advertising identifiers and aggregated campaign data with us.
From publicly available sources in limited circumstances, such as publicly available social media posts in which you tag TIPSY.
4. How We Use Personal Information
We use personal information for the following business and commercial purposes:
To operate our Services. Create and maintain your account, process and fulfill orders, manage subscriptions, deliver products, process returns and refunds, and respond to customer service inquiries.
To send communications. Send transactional communications (order confirmations, shipping updates, subscription notices); send marketing emails and SMS messages you have opted into; respond to your inquiries; and notify you of changes to our policies.
To deliver and measure advertising. Show you relevant advertisements on Meta (Facebook and Instagram), Google, and other third-party platforms; measure the effectiveness of our marketing campaigns; conduct attribution and conversion tracking; and create lookalike or similar audiences.
To improve our Services. Analyze how visitors use our Site, conduct A/B tests and experiments, develop new features and products, and improve user experience.
For marketing use of user-generated content. With your express consent, use photos, videos, and other content you submit or share on social media (including tagged posts) in our marketing materials, advertisements, and on our Site and social media channels.
To detect and prevent fraud and abuse. Verify identity, prevent fraudulent transactions, protect against security incidents, enforce our Terms of Service, and protect our rights and the rights of others.
To comply with legal obligations. Comply with applicable laws, respond to lawful requests from government authorities, defend against legal claims, and exercise or protect legal rights.
5. How We Share Personal Information
We share personal information with the following categories of recipients.
Service Providers
We share personal information with service providers under written contracts that limit their use of the information to providing services on our behalf.
- E-commerce and order processing: Shopify Inc., which provides our website infrastructure, checkout, and order management.
- Payment processing: Shopify Payments, Shop Pay, Apple Pay, PayPal, and other processors offered at checkout. These processors handle payment card information directly; we do not store full card numbers.
- Subscription management: Loop Subscriptions.
- Email and SMS marketing: Klaviyo, Inc.
- Analytics: Google LLC (Google Analytics 4).
- Shipping and fulfillment: Third-party logistics providers and carriers.
- Internal infrastructure: Our internal customer service, reviews, A/B testing, and analytics systems, which are operated by us on infrastructure providers (such as cloud hosting and database providers) under appropriate data protection agreements.
Advertising Partners
We share certain identifiers and event data with advertising partners to deliver relevant advertising, measure performance, and improve our marketing. This activity may be considered a "sale" or "sharing" of personal information under the California Privacy Rights Act and similar laws in Colorado, Connecticut, Virginia, Texas, Oregon, Montana, and other states.

Meta Platforms, Inc. (Facebook and Instagram). We use the Meta Pixel on our Site and the Meta Conversions API server-side to share event data with Meta. Data shared may include hashed email address, hashed phone number, IP address, browser user agent, Meta browser identifiers (such as
fbpandfbclid), pages viewed, products viewed, items added to cart, checkout initiation, purchase events (including product, value, and quantity), and similar event data. - Google LLC. We use Google Analytics 4 and may use Google advertising tags. Data shared may include IP address, browser identifiers, pages viewed, events triggered, and conversion events.
We do not share personal information with advertising partners for monetary payment. The sharing described in this section is for advertising and measurement purposes.
Other Disclosures
- Legal compliance: We may disclose personal information when required by law, subpoena, court order, or other legal process.
- Rights protection: To protect against fraud, security risks, illegal activity, and harm to TIPSY, our customers, or others.
- Business transfers: In connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of company assets, or other business transaction. We will use commercially reasonable efforts to provide notice if your personal information is transferred and becomes subject to a different privacy policy.
6. Cookies and Similar Technologies
We use cookies, web beacons, pixels, server logs, and similar technologies to operate the Site, analyze usage, deliver advertising, and personalize your experience. These technologies fall into the following categories:
Strictly necessary. Required for the Site to function, including cart and checkout, login, and security features. These cannot be disabled.
Performance and analytics. Help us understand how visitors interact with the Site, including via Google Analytics 4.
Advertising and targeting. Used to deliver relevant advertising and measure campaign performance, including via the Meta Pixel, Meta Conversions API (server-side), and Google advertising tags.
Personalization. Remember your preferences and customize your experience.
You can manage cookies through your browser settings. Most browsers allow you to block or delete cookies. Note that disabling cookies may affect Site functionality.
Global Privacy Control
We recognize and honor the Global Privacy Control ("GPC") browser signal. If your browser transmits a GPC signal, we treat it as a valid request to opt out of the sale and sharing of your personal information for the device and browser sending the signal. To enable GPC, use a supporting browser (such as Firefox, Brave, or DuckDuckGo) or install a supported extension.
7. Your Privacy Rights
Subject to your state of residence and applicable law, you may have the following rights regarding your personal information.
Right to know and access. Request information about the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for which we collected or shared it, and the categories of third parties with whom we shared it.
Right to delete. Request that we delete personal information we have collected from you, subject to legal exceptions (such as retention required for tax, accounting, fraud prevention, or legal defense purposes).
Right to correct. Request that we correct inaccurate personal information about you.
Right to opt out of sale and sharing. Opt out of the sale or sharing of your personal information for cross-context behavioral advertising. We honor GPC signals as described above. You may also submit a request through our Do Not Share My Personal Information page.
Right to non-discrimination. We will not discriminate against you for exercising your privacy rights. We will not deny you goods or services, charge different prices, or provide a different level or quality of service based solely on the exercise of these rights, except where permitted by law in connection with the financial incentive program described below.
Right to appeal. If you are a resident of Colorado, Connecticut, Texas, Virginia, Oregon, Montana, Delaware, New Hampshire, New Jersey, Minnesota, Maryland, Rhode Island, Kentucky, Indiana, Tennessee, or another state with an appeal right, and we deny your privacy request, you may appeal our decision by emailing hey@gettipsy.com with the subject line "Privacy Appeal" within sixty (60) days of our response. We will respond to your appeal within sixty (60) days.
8. How to Exercise Your Rights
You can submit a privacy request in either of the following ways.

Through our opt-out page: Visit our Do Not Share My Personal Information page.
Our Response
We will confirm receipt of your request within ten (10) business days. We will respond substantively to your request within forty-five (45) calendar days. We may extend the response window by up to an additional forty-five (45) calendar days when reasonably necessary, in which case we will notify you of the extension and the reason within the original response window.
Verification
To protect your privacy, we will take reasonable steps to verify your identity before fulfilling a request. We may ask you to confirm information we already maintain about you (such as the email address used to place an order, or your order number) to ensure that the request comes from you. The verification standard varies by the type of request and the sensitivity of the information involved.
Authorized Agents
You may designate an authorized agent to submit privacy requests on your behalf. We require the following to recognize an authorized agent:
- Written and signed authorization from you allowing the agent to act on your behalf, or a valid power of attorney, and
- Verification of the agent's identity, and
- Verification of your identity directly with us (unless precluded by a valid power of attorney).
9. Sensitive Personal Information
We do not collect, use, or disclose Sensitive Personal Information as defined under the California Privacy Rights Act. Accordingly, the right to limit the use of Sensitive Personal Information does not apply to our practices.
10. Children's Privacy
Our Services are intended for adults 18 years of age and older. We do not knowingly collect personal information from children under 18, and we do not direct our Services or marketing to minors.
If we learn that we have collected personal information from a child under 18, we will delete that information promptly. If you believe a child has provided personal information to us, please contact us at hey@gettipsy.com.
11. Data Retention
We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including:
- For active customers, the duration of your account or subscription, plus a reasonable wind-down period
- For transaction records, a period of at least seven (7) years following the last transaction, to comply with tax, accounting, and legal obligations
- For marketing communications, until you unsubscribe or otherwise withdraw consent, after which we may retain a minimal record of your opt-out to honor your preference
- For dispute resolution and legal claims, the period during which a claim could be brought plus applicable statute of limitations
- For backups and archived systems, a limited additional retention period during which deleted information may persist in backup form before being overwritten
We periodically review our retention practices and delete or anonymize personal information that is no longer needed.
12. Data Security
We implement commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, unauthorized access, disclosure, alteration, and destruction. These include encryption in transit, restricted access to personal information based on role, and regular review of our security practices.
No method of internet transmission or electronic storage is 100% secure. We cannot guarantee absolute security of your personal information.
In the event of a security incident affecting your personal information, we will notify you and applicable regulators as required by law.
13. Financial Incentives
We offer the following financial incentive program, as defined under the California Privacy Rights Act.
Subscribe & Save. Customers who enroll in our Subscribe & Save program receive a per-unit discount on TIPSY products compared to one-time purchase pricing.
- Material terms. Subscribers receive a discount on each recurring order in exchange for enrolling in recurring delivery. By enrolling, you authorize us to maintain a record of your subscription status, purchase history, shipping preferences, and related information necessary to administer the program.
- How to opt in. Select a Subscribe & Save option at checkout.
- How to withdraw. Cancel your subscription at any time through your account or by emailing hey@gettipsy.com. Cancellation is effective at the end of the current billing cycle.
- Value of the financial incentive. We have calculated the value of the financial incentive in good faith based on the expense of operating the program and the value to TIPSY of an ongoing customer relationship. Our reasonable estimate is that the value of the discount approximates the value to TIPSY of the related personal information (including subscription preferences, purchase frequency, and predictive purchasing data). The financial incentive is reasonably related to the value of the data to our business.
Participation in Subscribe & Save is voluntary and has no effect on your right to exercise the privacy rights described in this Policy. You may unenroll at any time without penalty.
14. User-Generated Content
When you submit reviews, photos, videos, social media posts tagging TIPSY, or other content to us, you grant us permission to use that content in connection with our Services. This may include use in marketing materials, advertisements, on our Site, in our email and SMS communications, and on our social media channels.
By submitting or tagging us in content, you represent that:
- You own the content or have obtained all necessary rights and consents to share it
- The content does not infringe on the rights of any third party
- You are at least 18 years of age
You may request that we cease using your content in our marketing by emailing hey@gettipsy.com. We will honor reasonable requests on a forward-looking basis, though we may not be able to remove content already distributed in print advertising or third-party materials.
15. Third-Party Links and Services
Our Site may contain links to third-party websites, services, and resources, including social media platforms. This Privacy Policy does not apply to those third-party sites or services. We are not responsible for the privacy practices of third parties. We encourage you to review the privacy policies of any third-party website or service before providing personal information.
16. International Visitors
Our products are sold and shipped only within the United States. We do not direct our Services to residents of the European Economic Area, United Kingdom, Switzerland, or other jurisdictions outside the United States.
Our Site may be accessible to visitors located outside the United States. If you access our Site from outside the United States, you acknowledge that any personal information collected will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.
We do not knowingly process personal data subject to the European Union General Data Protection Regulation (GDPR), the United Kingdom GDPR, or similar non-U.S. laws. We have implemented measures to limit the collection of personal information from visitors located in those jurisdictions.
17. State-Specific Notices
The following sections provide additional notices applicable to residents of specific states.
California. This Privacy Policy describes the rights and disclosures required under the California Consumer Privacy Act of 2018 ("CCPA") as amended by the California Privacy Rights Act ("CPRA"). California residents may exercise their rights as described in Sections 7 and 8 above. We have not knowingly sold the personal information of consumers under 16 years of age.
Nevada. Nevada law allows residents to opt out of the sale of certain personal information. We do not sell personal information as defined under Nevada law. If you are a Nevada resident and wish to submit a verified request to opt out, please contact us at hey@gettipsy.com.
Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Delaware, New Hampshire, New Jersey, Minnesota, Maryland, Rhode Island, Kentucky, Indiana, Tennessee, and other states with comprehensive privacy laws. Residents of these states have the rights described in Section 7 above, including the right to appeal a denied privacy request as described in that section.
18. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make changes, we will revise the "Last Updated" date at the top of this Policy.
For material changes, we will provide additional notice, such as by posting a prominent notice on the Site or sending an email to subscribers. Your continued use of the Site or Services after the updated Policy takes effect constitutes your acceptance of the updated Policy.
