Welcome to TIPSY Beverages, Inc. (“TIPSY,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of our website at gettipsy.com (the “Site”) and all related services, including purchases, subscriptions, and promotions (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

Our products are intended for adults 18 years of age or older. By using the Site, you represent that you are at least 18 years old and capable of entering into a binding agreement.

You must confirm your age via our clickwrap acknowledgment at checkout to make any purchase.

2. Use of the Services

You agree to use the Services only for lawful purposes and in compliance with these Terms and all applicable laws. We may suspend or terminate access to your account for fraudulent, abusive, or unlawful activity, or for violation of these Terms.

3. Account Creation

To purchase products or participate in programs such as subscriptions or rewards, you may need to create an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Orders, Payments, and Taxes

All orders are subject to acceptance and product availability.

We reserve the right to limit or refuse any order at our discretion.

You agree to pay the total amount shown at checkout, including:

  • Product price,

  • Applicable sales taxes, and

  • Any required container deposit or recycling fees (e.g., “can tax” in certain states).

Taxes and fees are automatically calculated based on your shipping address.

Customers are responsible for any applicable state or local taxes not collected at checkout.

Accepted payment methods include major credit and debit cards, Shop Pay, Apple Pay, PayPal, and other options shown at checkout.

5. Subscriptions and Autoship

By enrolling in a subscription, you authorize recurring charges to your selected payment method until you cancel.

  • You may cancel at any time after the initial 7-day period following your first order.

  • We will send email reminders prior to each renewal.

  • Changes or cancellations must be made before the next billing date to avoid being charged for that cycle.

All cancellations or updates can be made through your account or by emailing hey@gettipsy.com.

6. Shipping, Risk of Loss, and Fulfillment

We currently ship only within the United States.

Orders are fulfilled promptly, but shipping times may vary due to carrier delays or factors outside our control.

Risk of loss passes to you upon delivery of the package to the carrier. Once the carrier confirms delivery, TIPSY is not responsible for lost, stolen, or damaged packages.

7. Refunds and Returns — 100-Day Happiness Guarantee

We stand behind our products.

If you are not satisfied for any reason, you may request a refund within 100 days of your order date — no questions asked.

To initiate a return or refund, contact hey@gettipsy.com with your order details.

Refunds will be issued to the original payment method once the return or refund is approved.

We reserve the right to limit refunds in cases of suspected abuse or fraudulent activity.

8. Promotions, Discounts, and Rewards

Promotional codes, discounts, and special offers:

  • Cannot be combined or stacked.

  • Are valid for a limited time and subject to change without notice.

  • May be void where prohibited.

If you participate in a rewards or loyalty program, TIPSY may collect information related to your participation to administer benefits and communications.

9. Product Information and Disclaimers

TIPSY Beverages are functional zero-proof beverages designed for adult enjoyment.

They are not dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease.

Ingredient and Allergy Disclaimer

All product information, including ingredient lists and nutrition facts, is provided on our packaging and website.

Customers are responsible for reviewing ingredients prior to consumption.

If you have allergies or sensitivities, consult your healthcare provider before using our products.

Health Information Disclaimer

Information on our Site is for general informational purposes only and should not be construed as medical advice.

10. Intellectual Property

All content on the Site — including logos, product names, can designs, packaging, text, images, and other materials — is the property of TIPSY Beverages, Inc. or its licensors and is protected by U.S. and international intellectual property laws.

You may not copy, modify, reproduce, or use our intellectual property without prior written consent.

11. User-Generated Content

If you post reviews, photos, or content related to TIPSY (including tagging us on social media), you grant TIPSY a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with marketing, advertising, or promotional activities.

You represent that you own or have permission to share such content and that it does not infringe any third-party rights.

12. Limitation of Liability

To the fullest extent permitted by law, TIPSY Beverages, Inc., its officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or data, arising from your use of our products or Services.

Our total liability for any claim arising out of these Terms shall not exceed the total amount you paid for the product(s) in question.

13. Indemnification

You agree to indemnify and hold harmless TIPSY Beverages, Inc. and its affiliates from any claim, loss, liability, or expense (including reasonable attorney fees) arising from your breach of these Terms or misuse of the Services.

14. Arbitration and Dispute Resolution

By using our Services, you agree that any disputes or claims between you and TIPSY shall be resolved through binding arbitration, conducted in Orange County, California, in accordance with the rules of the American Arbitration Association.

You waive the right to participate in class actions or jury trials.

This provision does not prevent you from bringing claims in small claims court where allowed.

15. Termination

We may suspend or terminate your access to the Services, without notice, for conduct that we reasonably believe violates these Terms or applicable law, or harms other users, TIPSY, or third parties.

16. Governing Law

These Terms are governed by and construed under the laws of the State of California, without regard to its conflict-of-laws rules.

Any arbitration or legal action shall be filed and conducted in Orange County, California.

17. Changes to These Terms

We may modify these Terms at any time. Updated Terms will be posted on this page with the “Last Updated” date revised accordingly. Continued use of the Services after any changes constitutes your acceptance of the modified Terms.
